These terms govern your use of Ky El (also written Ky-El), Free Determinism AI, the website at ai.freedeterminism.com, and the companion apps that connect to this service. “We,” “us,” and “our” refer to the service operator, reachable at freedeterminismai.support@gmail.com.
In brief
Use the service lawfully, protect your account, and submit only content you have permission to use. AI and voice output can be wrong. Paid access is subject to the terms shown at checkout. Your data is handled as described in our Privacy Policy. These terms do not override rights that applicable law does not allow us to exclude.
1. The service and these terms
Ky El / Free Determinism AI provides AI-assisted conversations, voice interactions, companion experiences, research and assistance tools, and Free Determinism educational material, lessons, exercises, assessments, and learning records. Available tools also include user-directed website drafting and publishing. Features and access can differ by device, permissions, account access, and paid entitlement.
By using the service, you agree to these terms to the extent an agreement through use is recognized by applicable law. If you do not agree, do not use the service. You must have the legal capacity to agree, or the permission and supervision of a parent or guardian where required by law. A guardian authorizing use is responsible for that authorized use. This is not a promise that every feature is suitable for every age.
The public website and legal pages can be read without an account. Account-specific conversations and other protected features require sign-in. These terms do not grant access to features that require a separate entitlement.
2. Accounts and security
Authentication is handled through Clerk, including Google sign-in when you choose it. Google sign-in authenticates your identity; it does not connect the app to your Gmail messages, Google Drive files, or Google contacts.
Provide accurate account information, keep your credentials secure, and do not use another person's account without authorization. You are responsible for your authorized account activity. Tell us promptly if you suspect unauthorized access, and use your authentication provider's security controls. Do not send us passwords or authentication tokens.
Saved chats, preferences, and learning records can be associated with your account. Signing out, uninstalling an app, or clearing browser storage does not by itself erase these server-side records. Data controls and requests are described in the Privacy Policy.
3. Acceptable use
You must comply with applicable law and respect others' rights. Do not use the service to:
Create, solicit, or distribute unlawful content, sexual exploitation material, threats, targeted harassment, or instructions intended to cause unlawful harm.
Commit fraud, impersonate others deceptively, violate privacy, or submit or publish content you lack permission to use.
Upload malware, attack the service or other systems, interfere with availability, or gain unauthorized access to accounts, private records, or infrastructure.
Evade access restrictions, payment requirements, safety controls, or usage limits, or abuse automated requests in a way that disrupts the service.
Misrepresent AI output, assessments, or certificates as verified professional advice, an accredited qualification, or proof of facts they do not establish.
You remain responsible for what you submit, publish, share, or do based on a response. An AI response is not permission to act unlawfully or to infringe rights.
4. AI-generated information and learning
AI-generated answers, research, summaries, website drafts, companion responses, and learning feedback may be incomplete, inaccurate, outdated, biased, or inappropriate. Even an answer with citations can be wrong. Check important facts and original sources before relying on output.
The service is for information, assistance, and learning; it is not a substitute for qualified medical, mental-health, legal, financial, or other professional advice. Do not use it as an emergency service or as the sole basis for a high-stakes decision. For an emergency, contact appropriate local emergency services.
Companions are AI experiences, not human professionals. Lesson results, assessments, progress indicators, and certificates reflect activities within this service; they do not by themselves establish an accredited credential or a clinical or standardized evaluation.
5. Voice, AI providers, and external services
Voice requires the relevant microphone permission and enabled voice feature. Depending on the platform and mode, speech recognition or playback can use supported on-device features, browser/device services, or hosted processing. Some transcription and generated speech use ElevenLabs. Submitted text and relevant content are processed for AI responses using OpenAI through Replit infrastructure. Local recognition does not mean the submitted AI request stays on your device.
Speech recognition can mishear you. Review important transcripts, outputs, and proposed actions. Use voice controls or device settings to stop listening or revoke permissions. Do not record or submit others' information without the permission required by law.
Authentication, hosting, payments, media embeds, research sources, and destinations you choose can involve third-party services, including Clerk, Google, Replit, OpenAI, ElevenLabs, Stripe, and YouTube. Their services, availability, and terms are separate from ours. Opening a destination does not itself link your account to it. See the Privacy Policy for data-processing disclosures.
6. User-provided content and publishing
You retain any rights you hold in prompts, messages, images, documents, approved screen captures, website content, and other material you provide. You must have the rights and permissions needed to submit that material and allow the processing needed for your chosen feature.
You give us permission to host, store, reproduce, transmit, and process that content as needed to provide, maintain, and protect the service, including sending relevant content to service providers for your requests. This permission is not a transfer of ownership of your content. Retention and deletion limitations are explained in the Privacy Policy.
Saved account conversations are not automatically published as public websites. If you choose to publish a website or share content, that selected material can become accessible to visitors or recipients. Check it for personal information, accuracy, safety, and third-party rights before publishing or sharing it.
We do not guarantee that AI output is unique, copyrightable, accurate, or free of third-party rights. Other users may receive similar output. You are responsible for deciding whether you may use or publish it.
7. Subscriptions, purchases, and payments
Some access is free and some requires a subscription or one-time purchase. Stripe handles payment checkout. The product description and checkout identify the applicable amount, currency, billing arrangement, and any displayed introductory or renewal terms. Review those terms before completing payment; do not assume all products have the same billing schedule or access.
If you choose a recurring subscription, recurring charges apply according to the terms disclosed at checkout until cancellation takes effect under the applicable billing terms. Paid access depends on confirmed payment and entitlement status, and can be subject to the service's displayed usage limits. A failed or incomplete payment does not grant paid access.
Where available, the billing portal provides subscription and payment-management options through Stripe. Use those options or contact us for billing or cancellation help. Cancellation timing and effects depend on the applicable subscription terms; signing out, uninstalling, or not using the service does not itself cancel a subscription.
For billing errors, disputed charges, or refund requests, contact freedeterminismai.support@gmail.com. These terms do not promise an automatic refund or establish a blanket no-refund rule. Applicable consumer rights and any terms expressly supplied with your purchase remain in effect. Do not send full payment-card details to the support address.
8. Service availability and changes
The service depends on internet connectivity, supported software, device capabilities, permissions, and third-party systems. Features can be interrupted by maintenance, errors, provider outages, capacity limits, or changes outside our control. We do not promise uninterrupted availability, a particular response time, or identical capabilities on every device.
We may update, limit, or discontinue features as needed to operate the service. Changes affecting paid access remain subject to applicable law and the terms of the purchase. Keep your own copies of important content; do not use the service as your only backup.
9. Intellectual property
The service's software, design, branding, and original educational material are owned by the service operator or their respective licensors, except for your content and material identified as belonging to others. Access permits you to use the service as intended; it does not transfer ownership or grant a general license to redistribute protected materials.
Respect copyright, trademarks, and other rights. Do not copy, sell, or redistribute protected service material without permission, except as allowed by applicable law or an express license. Third-party material remains subject to its own rights and license terms. To report a rights concern, contact us with the affected material, its location, and an explanation of your rights.
10. Suspension and termination
You may stop using the service at any time. Manage any recurring subscription separately and contact us about account or data requests. Stopping use does not itself erase data or cancel billing.
We may restrict, suspend, or terminate access for misuse, a breach of these terms, security risks, nonpayment, or a legal requirement, subject to applicable law. Where appropriate and legally permitted, we may give notice or an opportunity to resolve an issue; urgent security or legal situations may require immediate action.
Termination does not remove obligations already incurred or rights protected by law. Provisions that by their nature apply after use ends, including intellectual-property protections and applicable liability provisions, continue to apply. Data handling remains subject to the Privacy Policy and applicable requirements.
11. Disclaimers
To the extent permitted by applicable law, the service and its output are provided “as is” and “as available,” without warranties of accuracy, reliability, availability, suitability for a particular purpose, or non-infringement. No conversation or AI answer creates a professional-client relationship.
Nothing in these terms excludes mandatory warranties, consumer protections, or other rights that cannot lawfully be excluded.
12. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive losses, including lost profits or opportunities, arising from use of or inability to use the service, reliance on AI output, interruptions, or third-party services.
This limitation does not exclude liability that cannot lawfully be limited, including any liability for fraud, willful misconduct, or other matters for which applicable law prohibits exclusion. Your mandatory consumer rights remain unaffected. Some jurisdictions do not allow particular limitations; in those jurisdictions this section applies only to the extent allowed.
13. Changes to these terms
We may update these terms as the service or legal requirements change. The current version and its effective date are published at this URL. For material changes, we will provide any notice or obtain any agreement required by applicable law. Continued use after updated terms take effect constitutes acceptance only to the extent permitted by law.
If part of these terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Nothing in these terms removes your non-waivable rights.
